BPA has secured planning permission for the change of use of an equestrian field to a dog exercise paddock with ancillary facilities and associated works.
In April, 2021, the applicants began renting the paddock to owners who required a secure area for exercising their dogs off-lead. There was evidently a demand in the locality, as the applicants had a number of regular users and therefore wished to secure retrospective planning permission to ensure the use is lawful. The paddock can now be utilised by owners and dogs who may not want to mix with others, have special requirements, or limited access to safe green spaces. The applicant also sought permission for the retention of the shepherds hut sited in the paddock. The hut provides users with shelter from the elements in addition to tea/coffee facilities and a WC. The final element of the application sought permission for a new vehicular access point and hardstanding for the parking of 2no. cars and an associated turning area.

BPA has secured full planning permission for 4no. high-quality detached dwellings in Stow-on-the-Wold.
Due to the sensitive nature of the site (Cotswold AONB and in close proximity to designated heritage assets) coupled with the sites complex and rather colourful planning history, we undertook pre-application discussions with the local authority. During which, we successfully established the principle of residential development on the whole of the site area, and sought to clarify from the council regarding the issues that needed to be addressed to secure a positive determination. The result is a cleverly designed scheme, incorporating features typical of the Cotswold vernacular with a contemporary twist.
Through our strong planning submission and positive engagement with the case officer, the application was approved under delegated authority.

Case Type: Change of use of an ancillary building to an independent dwellinghouse

Status: Appeal allowed & full costs award
BPA has secured planning permission on appeal, along with a full costs award.
Despite the advice of professional officers, the Council refused the application at planning committee due to the effect of the proposal on the character and appearance of the area.
BPA successfully argued that as the external appearance of the building would remain exactly the same as an extant planning permission, the reason for refusal could not be substantiated. The Inspector agreed and found the building to be of a high-quality design respecting the character and appearance of the locality. Accordingly, the Inspector found no conflict with the adopted Local Plan or Cotswold Design Code.
In addition to allowing the appeal, the Inspector held that the Council provided little evidence as to why it felt the development was considered to be of an inappropriate design. Consequently, the refusal of planning permission constituted unreasonable behaviour and the Council were ordered to pay the applicant’s full costs in the appeal proceedings.

Location: Shirehampton Road, Stoke Bishop, Bristol Case Type: Application to vary pre-commencement conditions Council: Bristol City Council Status: Approved Full planning permission was granted for the demolition of an existing garage and the construction of one new dwelling. The decision notice included 6 pre-commencement conditions, however construction works began on site prior to approval of the relevant details. As such, an application to vary the original permission was submitted in order to regularise the development already undertaken on site. It is important to read the decision notice in full before any work begins. If conditions are not discharged or adhered to you can be subject to planning enforcement action in the form of a Temporary Stop Notice which will prevent you from working on site, or a Breach of Condition Notice which will be visible indefinitely on all future land/property searches. You might also invalidate your planning permission which means that it cannot be implemented lawfully.
